Insurance company hypocrisy at its worst

Sometimes you just have to laugh when an insurance company makes an outrageous decision about a workers compensation claim. They never make these bad decisions based on medical evidence but only on how much money they can save.

As Michael Corleone said in the Godfather: “It’s not personal, Sonny. It’s strictly business.” We experience this nonsense on a daily basis and it’s hard not to take it personal for our clients. 

We have one client from Troy, MI who was denied medical treatment for a work injury that was established two years prior. He was cut-off from workers compensation even though an IME doctor supported his claim. Apparently, an issue came up as to whether an MRI was appropriate. Instead of just denying the MRI, all further medical benefits were disputed.

Want the punch line? After we filed the workers compensation case, the insurance company objected to their own IME medical report because it lacked “trustworthiness.” The insurance company has now filed a written objection seeking to keep this medical evidence out of court. It also happens to be from a doctor who is notorious for being used by insurance companies to deny workers compensation benefits.

Holding the insurance company accountable

We are very confident that the magistrate will reinstate medical benefits for our client. Our concern is for all of the other people who have had their workers compensation benefits stopped for a bad reason.

You should always fight an unfair decision from the insurance company. Legitimate workers compensation claims are denied every day and the reason is simple. It’s to save money at your expense. The insurance company is betting you don’t hire a lawyer and just go away. Prove them wrong!

What to watch out for

When you are scheduled for an independent medical examination (IME), your workers compensation benefits could be in jeopardy. These medical examinations are typically used to deny rather than grant benefits. Don’t be fooled into thinking it’s a second opinion to help you.

You should also be concerned if you are scheduled for a vocational assessment or wage earning capacity analysis. A vocational counselor will be hired to find jobs that you can perform. The problem is that your idea of a job and their idea of a job will be very different. You may even find that your wage loss benefits are reduced based upon a job that you don’t even have.
