Why you need a Michigan workers compensation attorney and five tips to get a larger settlement.
Here is our updated list of tips to help you get a better settlement. Remember that every case is different and it is important to find an attorney in your local area.
1. Select your own doctor
Michigan law allows you to select your own doctor after 28 days. This is important because it helps you avoid future problems. Insurance companies like to choose your medical providers because it gives them greater control over restrictions and the type of care provided. Many of these doctors receive a large portion of their patients from insurance companies and this creates a potential conflict of interest. You need a doctor who will be on your side every step of the way.
2. Do the math yourself
Lost wages are available through workers compensation. You are supposed to receive 80% of your after-tax average weekly wage. Overtime, bonuses, and fringe benefits are supposed to be included. We find that insurance companies frequently make mistakes and underpay. Look at your wage records and make sure that you are getting the correct amount. Use the highest 39 paid weeks before your injury. Call an attorney if you need help. The amount of benefits owed directly affects the value of any settlement.
3. Look for a new job
Insurance companies are allowed to subtract money from your weekly checks if you can work somewhere else. This is based upon “wage earning capacity” and it does not matter if you are actually working. A good faith job search will prove that no employer will hire you with restrictions. This is an important part of your case to show total disability.
4. Come up with a plan
We recommend that you come up with a plan for the future. You might want to go back to school or simply find a new job. Some of our clients start new businesses and hire people to do heavy lifting. Social Security Disability might also be an option if you cannot return to work. You should talk with a Michigan workers compensation attorney before any decisions are made.
5. Get help from an experienced attorney
The amount of settlement can be dramatically affected by making the wrong decisions. You should realize that even innocent questions asked of an insurance adjuster could ruin your chances for recovery. Insurance companies look for any excuse to dispute benefits. Get help before minor problems turn into major issues.
