Magistrate Disposition Statistics (01/01/2013 – 09/30/13)

Agency releases more bad news for people who are seeking workers compensation benefits in Michigan.

Statistics for 2013 do not look promising. Only 12 open awards have been granted. This is contrasted by 52 denials. If you include 17 closed periods, the chances of recovery at trial improve to just 55%.

More of our clients are finding their wage loss benefits automatically reduced based upon imaginary wages. The insurance company says work is available but no job is actually offered. We have also seen a sharp increase in disputed claims based upon pre-existing conditions.

The blame falls squarely on the Michigan Legislature when it amended the Act in 2011. It has become so difficult to prove a case that many people walk away with nothing. Disabled workers must also hire expensive vocational experts and look for jobs that don’t even exist.

Fixing the system
