5298151724_015038426c_mWe understand the financial toll that comes with a serious work accident. If a person is lucky, he or she will receive 80% of their after-tax average weekly wage. Not exactly a windfall for a person trying to recover from injury.

Some workers comp claims are disputed and no wage loss benefits are ever paid. This can be devastating for families living paycheck-to-paycheck. We have also seen some individuals have their weekly checks slashed to almost nothing based upon wage earning capacity.

Many of our clients want to settle their workers comp claims. This provides freedom to do vocational rehabilitation and medical treatment on their own terms. It also eases financial worries and stops insurance company interference.

If a person decides to settle his or her claim, it must be approved by a magistrate at a redemption hearing. The magistrate will be given an explanation as to why the case is being settled and will review medical records. A settlement will not become final for 15 days.

During the 15 day appeal period, it is possible for both sides to seek a redemption review. A settlement cannot be set aside without good cause or a legal reason. Changing your mind is not considered good cause. A settlement check is typically mailed a week after the 15 day appeal period expires.

If both sides agree, the 15 day appeal period can be waived. Settlement is final on the redemption date and a check can be sent out immediately. Some of our clients have even received their settlement checks on the very same day.
