Magistrates decide the facts and law for each workers’ compensation case. Their backgrounds shape how they view medical evidence and witness testimony.
Statistics published by the WCA show magistrates have given 6 open awards, 16 closed awards, and 20 denials so far. This period covers January 1, 2017 until September 30, 2017. We believe these statistics are useful when evaluating a case for settlement or trial.
An open award is when a magistrate orders payment of continuing wage loss and medical benefits. A closed award is when a magistrate orders the payment of some benefits. Denials result in no workers’ compensation being paid.
