TMZ has reported that Jim Carry was fined $72,000 by the State of New York for not having workers comp insurance for his art studio in 2012. A rep for Carrey tells TMZ: “This is a clerical error on their part and will be cleared up immediately.”

Michigan employers who must carry workers comp insurance

Private employers who have 3 or more employees at one time or have less than 3 employees if at least one of them has been employed for 35 or more hours per week for 13 weeks or longer during the preceding 52 weeks.

Households employing domestic servants 35 hours or more per week for 13 weeks or longer during the preceding 52 weeks.

All public employers.

Work comp rights for injured employees

Employers are still required to pay workers comp even if they do not have insurance. This means that medical and wage loss benefits must be provided. However, collection is always a problem.

Employers who fail to obtain required workers comp insurance could be subjected to criminal penalties. Officers of the company could also be personally liable.

The uninsured employer is not protected by the exclusive remedy provision. This means the injured worker can file a separate action against the employer for negligence.
