Michigan disability lawyer explains other benefits that you can collect while fighting for your workers comp.

Workers comp is supposed to pay for lost wages and medical care. When your employer or its insurance company disputes these benefits it can be overwhelming. This is especially true when an injured worker is the only source of income for a family.

Here are some alternatives that you can use while challenging a workers comp denial.

Social Security Disability

Social Security Disability pays monthly benefits to people who cannot work because of sickness or injury. You qualify based upon past work credits or financial need.

You can also receive Medicare under certain circumstances. This is health care provided by the federal government to seniors and disabled individuals.

Never apply for Social Security Disability without first talking to an experienced workers comp lawyer. You could have substantial obligations to the federal government if your workers comp case is ever settled.

Medicaid

This is a state program that provides medical benefits to low income individuals. Medicaid will pay for treatment that should have been provided by workers comp. You must reimburse Medicaid if you are successful in recovering workers comp benefits. Some doctors do not accept Medicaid and your treatment options may be limited.

Unemployment

An individual can collect both unemployment and workers comp benefits under certain circumstances. You must be available and seeking work within your restrictions.

A situation could arise where you are disabled from one job but be able to do another.  You might not be able to do heavy work but you could do a sit-down job if available. The idea is that you are looking for work within your restrictions but you still have a loss of maximum wage earning capacity because of your work injury.

Your employer or its insurance company will get a credit against any unemployment benefits that you receive.

STD/LTD

Long-term disability is a type of insurance that pays a portion of your salary if you cannot work because of a medical condition. It is typically purchased as part of a group policy through your employer. 

Long-term disability does not normally cover work injuries. However, most insurance policies will pay while your workers comp case is pending.

You will need to reimburse the insurance company if you later receive workers comp. A skilled workers comp lawyer can minimize any payback for benefits received.

Group health insurance

Most health insurance companies will pay disputed medical bills when you have a pending workers comp case. You may have to sign a reimbursement agreement and pay them back out of the proceeds of any settlement or award.

Many times this is your best option to get medical treatment while your workers comp is disputed.
