Don’t give them an excuse to deny your benefits.

1. Late notice

All injuries should be reported promptly to a supervisor or manager. Telling your employer the next day is a red flag that will be used to  deny benefits. It is better to error on the side of caution then to wait a few days to see if an injury resolves on its own.

2. Using insurance company doctors

Michigan law says that an employer can select your doctor for the first 28 days. This means that you will most likely been seen at an industrial clinic. Our experience shows that these facilitates provide substandard care. Many of our clients have been told they simply have a sprain when their condition is much more serious. We suggest that you treat with your own doctor as soon as possible.

3. Not checking the math

Workers comp pays lost wages equal to 80% of your after-tax average weekly wage.  Insurance companies will estimate this amount and it is never in your favor. The only way to get an accurate amount is by looking at  wage records. Take the highest 39 weeks in the last 52 and add them together. Overtime and premium pay should be included.

4. Quitting your job in anger

Many of our clients are told to return to work with restrictions. Some are given demeaning jobs. The employer wants the person to quit because this means forfeiture of wage loss benefits.
