New legislation would require employers to post up-to-date proof of workers’ compensation insurance.
Representative Scott Dianda (D-Calumet) has introduced House Bill 5698 requiring employers to post notice of workers’ compensation insurance in a conspicuous location at each place of employment. This legislation has bi-partisan support with 56 co-sponsors. Employers who refuse to comply would be subject to a civil fine up to $7,000.00.
UPMatters.com interviewed Dianda who hopes that “by requiring everyone to post proof that they have workers’ comp insurance, this will remind them that they must follow safety rules. If they fail to post the notice that will flag the business for the Michigan Department of Licensing and Regulatory Affairs inspectors so that they can work with them on following all safety rules.”
We support this legislation and believe it is long overdue. Michigan law requires employers to purchase workers’ compensation insurance to protect employees hurt on-the-job. It covers medical care and lost wages. In exchange for these limited benefits, employers receive protection from civil lawsuits. It is a grand bargain of interests.
Unfortunately, our experience shows that some bad employers try to game the system to save costs. Employees hurt at work are told no workers’ compensation insurance exists to discourage them from making a claim. Employees are asked to lie to doctors about how the accident occurred in exchange for rarely kept promises of “under the table” payments.
