Employee responsibilities after getting hurt at work and reasons why employers dispute workers compensation benefits.

There are some issues that we see over and over again in our disputed cases. We call these “red flags” that employers and insurance companies exploit to deny benefits. Many of them could have been avoided with some basic knowledge about Michigan’s workers compensation law.

Reporting  a work injury immediately after it occurs is critical to your case. It is also perhaps the easiest thing you can do to protect your benefits. Here is some information about notice and claim that you should know about.

Notice

You must provide notice of injury to your employer within 90 days. Notice can be oral so if you told a supervisor or manager this might be enough. We recommend that you fill out an accident report so that it is documented.

Employers and insurance companies deny benefits to people who wait to report an injury. They always assume you are lying and actually hurt yourself at home. Most people do not realize the extent of injury until a couple days later. We think it is important to report all injuries immediately after they occur.

Claim

You must also make a claim for workers compensation benefits within 2 years. Claim can be oral so simply asking for medical treatment or wage loss benefits under workers compensation should be sufficient.

Some employers refuse to submit claims to insurance companies. This is usually done out of fear that premiums will rise. We recommend that you contact a lawyer if this occurs. Don’t let the employer ruin your life just to save a few bucks.
