Michigan work injury attorney explains why you can’t be fired for seeking workers comp benefits and how to protect your interests.

The most frustrating part of my job is seeing good people treated poorly after an injury at work. What usually happens is that an employer will dispute an injury and refuse to pay workers comp benefits.

Sometimes an employer will go even further and fire someone just because he or she asked for workers comp benefits. This is against the law!

Your employer can always dispute paying workers comp benefits if they believe your claim is not valid. However, your employer cannot fire or discriminate against you just because you asked for workers comp benefits.

What the workers comp law says

MCL 418.301(13): A person shall not discharge an employee or in any manner discriminate against an employee because the employee filed a complaint or instituted or caused to be instituted a proceeding under this act or because of the exercise by the employee on behalf of himself or herself or others of a right afforded by this act.

If you believe that you were fired or discriminated against because you asked for wage loss or medical care, you might have a case for wrongful termination. You can protect yourself by documenting everything and by calling an attorney.
