One of the biggest concerns our clients have is the length of time it takes to resolve a litigated workers comp case. We understand and do everything possible to speed up the process.

There are numerous reasons why a case might take a long time to resolve. Here are our five suggestions on how you can help your lawyer speed up the process and get a great result.

1. Don’t live in a bubble

It’s tempting to get depressed and shut yourself away after an injury. The most important thing you can do is communicate openly with your lawyer. This does not mean calling and asking for a status update every other week. It means telling your lawyer about your concerns and letting him or her come up with a strategy to help. You may find that settlement is even better than winning your case at trial.

2. It’s all about the medical

Keep your lawyer informed of changes to your medical condition. He or she needs to know about future treatment and restrictions. If you are seeing a new doctor, these records must be obtained. Fax or e-mail restriction notes to your lawyer. If you have reached maximum medical improvement (MMI), it might be time to ask for a lump sum cash payment.

3. Starting a new job

Your lawyer needs to know if the employer has called you back to work. It is also important to tell your lawyer if you are starting a new job somewhere else. Call your lawyer and provide your return to work date and how much you will be earning. If you are only seeking a closed period of benefits, this can be resolved much more quickly.

4. Keep track of your medical bills

We tell all of our clients to keep track of their medical bills. Keep a list of providers and how much you owe. Attach medical bills and collection notices to this list. Provide this information to your lawyer on a regular basis. This will ensure that your medical bills are paid and nothing falls through the cracks.

5. Tell us where you are

Always notify your lawyer when you change your address or telephone number. Your lawyer might have important information that will advance the case. Performing a disappearing act will only slow down the process. This is especially true if you keep missing the independent medical evaluation (IME) because the notice is being sent to the wrong address.
