What can be learned about workers’ comp from a small badger named Punxsutawney Phil?
People across the United States will be celebrating Groundhog Day on February 2, 2018. A small badger named Punxsutawney Phil will be plucked from his hole and forced to predict the weather. According to legend, if he sees his shadow, there will be six more weeks of winter weather. If he does not see his shadow, there will be an early spring.
This holiday has given rise to numerous pop culture references including the classic film ‘Groundhog Day’ staring Bill Murray. He plays a weatherman who relives the same day over and over again.
Many of our clients feel like they are living in the movie Groundhog Day. Here are some workers’ comp issues they deal with over and over again.
Independent Medical Examination (IME)
Insurance companies use the same doctors over and over again. These people make careers out of testifying against people who got hurt at work. A person could be sent to an IME 3, 4, or even 5 times until the desired cut-off is achieved. We have seen some insurance companies use multiple doctors until they get a cut-off.
Job Search Requirement
Michigan law requires individuals on workers’ comp to perform a job search. Unfortunately, there are no rules about what constitutes “good-faith.” We have disabled clients who are forced to apply to similar jobs over and over again. Most employers have no interest in hiring a person who has restrictions and cannot perform all required job duties.
Missing Wage Loss Checks
Insurance companies are required to start payment 14 days after benefits are due. Checks are supposed to be mailed on a weekly basis. Many of our clients find weekly payments delayed because the “system” kicked them off and it must be restarted manually. Checks that usually arrive on a Monday are now coming on Friday or not at all. It usually takes a telephone call to the insurance company to fix the problem. This happens over and over again.
