Our law firm is closed today but we know many people have to work on this independence day. We hope that you stay safe and get home early to be with friends and family.

On most holidays we like to reflect on changes to the workers comp law. We think it’s important to remind people that taking care of workers is what has made this country great. Ask someone in China about wages paid or what happens if a person suffers a work injury.

Before Michigan enacted its first workers comp law in 1912, many individuals who suffered a serious work injury were not adequately compensated. It did not matter if the person was permanently disabled or could ever work again.

Today, we find the rights of injured and disabled workers threatened once again. Special interest groups have managed to change the law and have thrown our delicate system out of balance.

Workers comp is supposed to be a compromise of employer and employee interests. We should not be racing to the bottom in what we pay people who are seriously hurt at work.

What’s the big deal?

Insurance companies and self-insured employers can now reduce a person’s wage loss benefits based upon a job they think is available. It does not matter if the person is hired or not.

The part of the law that encouraged employers to bring partially disabled employees back to work with restrictions has been rendered worthless. Why offer a disabled employee a real job when you can just reduce benefits based upon made up wages?

This is happening and it needs to stop!

How to set things right

We can change the workers comp law and make a difference if we all get politically active. Most people are not interested in workers comp until an injury happens to them or a loved one.

It is our duty as Americans to inform friends and family about the challenges facing injured workers and to encourage them to vote. Together we can make a difference!
