Here are some New Year’s resolutions that you can adopt in 2013. Remember that a successful workers comp case is a marathon not a sprint.

1. Don’t give up hope

Insurance companies routinely deny workers comp claims. It is your responsibility to hold them accountable for their bad actions. Over 95% of our clients receive monetary compensation after their case is filed. Don’t just walk away with nothing.

2. Try favored work if offered

Some employers ask that you come back to work with restrictions. Your wage loss benefits will be forfeited if you do not accept this reasonable employment. This is often used as a tactic to get you to quit and give up your workers comp benefits. You can always go home if your restrictions are violated or the pain is too much.

3. Look for a new job to prove your case

You are required to look for employment under 2011 changes to the law. This is true even if you are still employed or collecting Social Security disability benefits. A job search proves that you cannot be hired because of your work injury. Failure to look for work can result in denial of your benefits. This is especially true if you are only partially disabled and have a wage earning capacity. Don’t wait until the week before trial to start building your case.

4. Tell the truth about workers comp

The vast majority of people don’t understand workers comp. They have been told it’s a free lunch for individuals who don’t really want to work. You can help dispel this myth by telling friends and family members about your own experience. This goes a long way to counter the nonsense from special interest groups who want to deny your benefits.

5. Get help before your benefits are denied
