What you need to know about workers compensation benefits in Michigan and how to get help with your work injury claim.

Most people are not aware of their legal rights or what happens after an injury at work. The stress and uncertainty can be overwhelming. We understand and want to help.

Workers comp is designed as a compromise between employee and employer interests. Benefits are paid regardless of fault but are limited in amount and duration.

Here is some information you should know about workers compensation benefits in Michigan. Remember that every situation is different and it is best to contact an experienced workers compensation lawyer.

Lost wages

Wage loss benefits are designed to compensate you for missing work. You should receive 80% of your after-tax average weekly wage. This is usually about 60% of your gross pay. Watch out for insurance companies who say you are only partially disabled and automatically reduce this amount.

Medical treatment

Reasonable and necessary medical treatment must be provided under Michigan law. This includes visits to the doctor, physical therapy, surgery, prosthetics, and prescription medications. You have the right to choose your own doctor after 28 days.

Attendant care

Relatives can be paid up to 56 hours per week to help with activities of daily living. The hourly rate must be competitive with what an outsider would charge. A professional can also be hired if a person needs more than 56 hours of attendant care.

Mileage reimbursement

Travel expenses related to medical treatment should be paid by the insurance company. This includes reimbursement for mileage, lodging, and meals.

Home & vehicle modifications

Sometimes it is necessary to modify your home or vehicle to accommodate a wheelchair. This includes bathrooms, kitchens, hallways, doors, and ramps.

Vocational rehabilitation

Vocational rehabilitation may include tuition reimbursement or retraining for another job. A vocational counselor can also help with your resume and job search activities. Make sure the person hired by the insurance companies has your best interests at heart.
