Our law firm will be closed on May 27, 2019 in recognition of Memorial Day. This federal holiday occurs on the last Monday of May and commemorates those who lost their lives while in military service. Many people visit cemeteries and memorials to recognize their sacrifice. Communities sponsor parades across the United States and a national moment of remembrance takes place at 3:00 p.m. local time.

Memorial Days is also the unofficial start of summer. Activities like family barbeques, swimming, and outdoor sports are common around Michigan. Retailers will also be offering discounts with holiday sales.

Our blog readers are encouraged take some time away from these summer activities and exercise their political freedoms. We can think of no better way to honor men and woman who died serving our country. Here are three suggestions on how to make a difference and fix workers’ compensation.

Use the political process and reach out to elected representatives

Many of our clients are upset to learn how much workers’ compensation pays when they are disabled from their jobs. It can be shocking to find out that wage replacement is only about 60% of gross pay. This amount can be reduced even further based upon residual wage-earning capacity. This is when an insurance company uses “phantom wages” from hypothetical jobs as an offset. Supporting a family on 60% pay is difficult and nearly impossible on less.

It is up to the Michigan Legislature to fix the problem. We suggest contacting your local elected representatives and telling them to get rid of phantom wages. Disabled employees should come before insurance company profits. Make a telephone call, send a fax, or write an email.

Free speech allows you to talk about workers’ compensation

We have heard many sad tales about workers’ compensation. Disabled employees cannot pay the mortgage and lose their home. Individuals who are hurt must choose between getting medical treatment or putting food on the table. Few seem to care that lives are ruined.

Special interest groups have pushed a narrative that people on workers’ compensation are just faking it. The truth is that nobody gets rich from workers’ compensation and businesses are paying much less premiums. Fight propaganda with your truth! Tell friends and family members about your individual experience under workers’ compensation.

Stand up for your legal rights in court

Insurance companies dispute payment of workers’ compensation benefits for all kinds of questionable reasons. It can be based upon preexisting accidents from 30 years ago or biased medical reports from IME doctors.

Michigan law allows a person to file an Application for Mediation or Hearing. Evidence can be presented to a magistrate showing a need for additional medical treatment and/or wage loss benefits. Unfortunately, many people do not challenge a dispute and just give up.
