We regularly receive telephone calls from around the country asking whether an injury in another state could be covered in Michigan.  The reason is because workers compensation benefits in Michigan are usually more generous than the state of injury. 

Michigan workers compensation pays unlimited medical treatment and wage loss benefits for  as long as the employee is disabled. Vocational rehabilitation is also available for retraining or job placement.

What the law in Michigan says about out-of-state injuries

Michigan workers compensation is available for out-of-state injuries if either the employee is a resident of this state at the time of injury or the contract of hire was made in this state.

The law before January 13, 2009 required both residency and a contract of hire.  The change in the law is not retroactive for old injuries.

The issues of residency and contract of hire can be complicated. You could have a temporary residence in one state but have a permanent residence in Michigan. You might have been hired in Michigan but underwent orientation in another state.   It is best to speak with an experienced workers compensation attorney about your specific situation.

Multiple recoveries for the same injury in different states are possible

An employee who receives workers compensation benefits in one state is not prohibited from seeking benefits in Michigan. The employer  would get a credit for any benefits paid but the only way to end liability for  workers compensation in Michigan is with the approval of a magistrate.
