The 2012 election is over and Michigan voters have decided to keep the status quo. Here is our two cents on how workers comp is affected.
Justices Markman and Zahra have been re-elected. This means that the Republicans will maintain a 4-3 majority in the Michigan Supreme Court. Republicans have also kept their majority in the Michigan House of Representatives.
All branches of Michigan government will continue to be under exclusive Republican control. Unfortunately, this keeps workers comp in the cross hairs and puts your benefits at risk.
House Bill 5002 (workers comp reform)
It is no secret that this legislation was passed along Republican party lines. Decades of workers comp law was thrown aside in less than 90 days. Not bad for a group that usually can’t get anything accomplished.
Special interest groups used enormous political pressure to ensure passage of these changes. It was advertised as helping “job creators” but was just a money grab.
Insurance companies can now reduce benefits using a hypothetical wage earning capacity. It does not matter if the person has actually returned to work or not. It is also much more difficult to get benefits for an occupational disease or psychiatric disability.
Employers and their insurance companies are saving money but the unemployment rate continues to be over 9%. So where are these new jobs that have been promised?
