Warning about Liberty Mutual Affidavit

Liberty Mutual has begun sending form letters to individuals on workers’ compensation. The letter requests an affidavit be returned with specific information provided.

An affidavit is a legal document that is signed and notarized. It is taken under oath and can be used as evidence in a court proceeding.

Some of the information requested by Liberty Mutual includes a statement of current medical condition, whether any other health problems exist, sources of other income, and whether settlement would be considered. This is clearly a fishing expedition to get information that could affect payment of benefits.

The letter claims that Liberty Mutual is required to complete an up to date activity check on the file. Michigan law does not require insurance companies to perform activity checks and there is no rule that a claimant must give a sworn affidavit.

A claimant must provide information about his or her medical treatment. Information about new employment could also be required. However, we feel this affidavit is an overreach and can only be used against interests. We recommend that you speak with a lawyer if you receive this document.
