Driving for your job in the winter months can be extremely dangerous but workers’ compensation is available to protect you in the event of an auto accident.

Employees hurt while driving for their jobs are covered by workers’ compensation insurance. Benefits include lost wages and medical care. It does not matter who was at fault for the accident.

Notice must be given to the employer within 90 days and claim must be made within 2 years. It is recommended that notice and claim be made right after an accident. Medical attention should also be sought immediately.

Accidents going to and coming from work are generally not covered. Exceptions apply if on a special mission for the employer, vehicle costs were paid by the employer, dual purpose travel, excessive traffic risks, or a split-shift schedule was required. These are complicated situations that should be evaluated by an attorney.

Employees who slip and fall should also be covered if they are in the course and scope of employment. This includes entering or exiting a vehicle.

Employees who are involved in a accident may also be entitled to auto no-fault benefits. A claim against the at-fault driver is also possible. We recommend contacting an experienced attorney to ensure all potential claims are investigated.
