Michigan workers comp lawyer explains how to get medical treatment even though your claim has been denied.

Many of the people who call our office have been denied medical care under workers comp. This means they will not receive medical treatment that is needed. This can be a disaster for a person who is in chronic pain and must have surgery.

Unfortunately, some employers and insurance companies just don’t care. The only medical opinion they will accept is from a doctor who is already in their pocket.

Here is some information about how you can secure medical treatment and seek reimbursement from workers comp later.

Private health insurance

Most group health insurance companies will pay disputed medical bills provided that you sign a reimbursement agreement and pay them back if you are successful with your workers comp case.

This allows you to get medical treatment immediately rather than waiting until your case is resolved. This also allows you to obtain important evidence that you have a  disability and it is work-related.

The burden is on you to instruct your doctors to bill private insurance. You may need to provide a Notice of Dispute.

Medicaid

Medicaid is  an insurance program that provides medical assistance to individuals with limited resources.  Medicaid pays low rates and it is sometimes difficult to find a doctor who will accept this kind of insurance.

You can use Medicaid to pay disputed medical bills. However,  reimbursement is required out of any settlement or award from workers comp.

Medicare

Medicare is a form of health insurance provided by the federal government for people who are disabled or have reached retirement age. Medicare is accepted by most doctors and hospitals.

Medicare makes conditional payments for treatment that should be paid under workers comp. You have significant legal obligations should you later settle your workers comp case.
