Michigan workers compensation lawyer talks about a class action lawsuit filed against Walmart alleging interference with medical providers.
The Denver Post reports on an 8 million dollar settlement reached with Walmart regarding workers compensation. Employees alleged that Walmart hindered medical providers from making independent judgments on how to treat work injuries. Concentra and CMI were also included in the lawsuit and will join in the settlement.
Walmart Stores and Claims Management Inc., its third-party administrator, to pay $4 million. Concentra Health Services, through its insurer, will pay another $4 million.
We think this is great news and another victory for injured workers. Employers and insurance companies must be held accountable if they break the rules.
What’s the big deal about workers compensation?
Workers compensation is a compromise of employer and employee interests. It is designed to protect both parties in the event of a work injury. Benefits are paid regardless of fault.
Problems arise when employers and insurance companies try to game the system. Valid claims are disputed just to save money.
This typically occurs when medical benefits are denied based upon an “independent medical examination.” There is nothing independent about these examinations because the doctor is handpicked by the employer or insurance company.
In Michigan, during the first 28 days after injury, you must treat with a doctor selected by the employer. Our clients are routinely sent to Concentra or some other employer clinic.
