What happens when a claims adjuster does not understand Michigan workers’ comp law and how can a person get help with disputed benefits?

This was recently demonstrated when a claims adjuster contacted our office with basic questions. It was quite amusing to our lawyers because we do not represent employers or insurance companies. Some claims adjusters think disputing benefits is a big game. Their goal is to save money for the insurance company. Common problems include failure to approve medical treatment and missing wage loss checks.

People hurt on-the-job have the right to know what is happening with their workers’ comp claim. An insurance company cannot simply dispute payment for no good reason. It is critical to ask why medical treatment is not approved or wage loss benefits are cancelled. If the answers given are not satisfactory, it is important to contact an experienced workers’ comp lawyer.

Red flags to watch out for include rude behavior, not returning telephone calls, late checks, being scheduled for an independent medical examination (IME) or employability and wage-earning capacity assessment.
