Michigan workers comp lawyer provides the latest information on House Bill 5002.

The Michigan House of Representatives has passed House Bill 5002. The vote was mostly along party lines with only four Republicans voting against. No Democrats supported House Bill 5002. The final count was 59 yeas and 49 nays.

Several changes were made to the passed version but it retains the concept of partial disability and virtual wages. The amount of time an employer or insurance company has to select your medical providers was changed to 45 days. The Qualifications Advisory Committee has been abolished and new magistrates will be appointed at the sole discretion of the Governor.

Proponents of this legislation are claiming that workers comp benefits will not be reduced based upon imaginary wages. Read House Bill 5002 and make your own conclusion:

“Wage earning capacity means the wages the employee earns or is capable of earning at a job reasonably available to that employee, whether or not actually earned.”

Where do we go from here?

House Bill 5002 moves to the Michigan Senate. It is likely that additional changes will be made and a final version needs to be approved by both chambers. It will then go to the Governor for his signature and is expected to become law.

We encourage you to speak with your Senator and tell him or her to oppose this horrible legislation. Special interest groups are spending big money to make sure this law passes. These changes can only be stopped if enough people contact their elected representatives and demand that workers comp be protected.
