There are several workers compensation benefits that you should know about when you suffer a work accident.  You are entitled to unlimited medical treatment and wage loss benefits.  Workers compensation is considered a no-fault system and it does not matter if you caused the accident. 

You may also receive additional compensation from a third-party if they caused the accident.  This situation usually occurs when you are injured in a car accident while on-the-job.

Workers compensation benefits for an accident

All reasonable and necessary medical treatment should be paid under workers compensation.  This is not health insurance and you can only get medical treatment that is directly related to your injury.  You will not have to pay any co-pays and the bills should be sent directly to your employer or its insurance company.

The amount of wage loss benefits depends upon how much you earned at work.  You can get 80% of your after-tax average weekly wage.  Wage loss will be paid for as long as the accident keeps you from working.

Pain and suffering

You are strictly limited to workers compensation benefits from your employer.  This is known as the exclusive remedy provision.  You get automatic workers compensation benefits but cannot sue for pain and suffering or any other damages.

However, you can sue a third-party for pain and suffering if they were at fault for the accident. These types of claims often involve negligent drivers or manufacturers of machines and equipment.
