Our Michigan workers compensation lawyers are helping to raise awareness for traumatic brain injury (TBI) and offering suggestions on how you can help.
TBI is one of the most serious injuries that can happen at work. Long-term effects include memory problems, headaches, dizziness, sensitivity to light and sound, nerve damage, seizures, and personality change. These types of injuries can be life-altering and can permanently effect a person’s ability to work.
TBI can happen to anyone. The Brain Injury Association of America says that 1.7 million people each year will sustain a brain injury. They are joining with a nationwide network of state brain injury organizations, including self-advocates, families and volunteers across the nation to raise awareness this March.
The attorneys at Michigan Auto Law have even pledged up to $10,000 in donations to the Brain Injury Association of Michigan for every “Like” on their Facebook page.
Michigan Workers Compensation
Here is some information about traumatic brain injury and workers compensation in Michigan. If you or a family member needs legal help, we are just a telephone call away.
All reasonable and necessary medical treatment should be paid under workers compensation without co-pays or deductibles. After 28 days from the start of medical care, you can select your own doctor. The insurance company cannot dictate your medical treatment.
Attendant care is available to help with activities of daily living. This includes taking medications, using the bathroom, getting dressed, and sometimes just patient-sitting. The insurance company must hire a professional to provide these services. A family member can also be paid up to 56 hours per week to help. A family member should be paid the same as a professional.
Payment of lost wages is required under workers compensation. The amount of wage loss benefits is fixed at the time of injury and equals 80% of your after-tax average weekly wage. This amount will stay the same even if the economy changes or your job is eliminated.
Sometimes you will need to see multiple specialists before a proper diagnosis can be made. You should receive mileage reimbursement for every time you visit a doctor or have a medical test.
How you can help
People who are affected by brain injury don’t always want to get help. They might find themselves quick to anger and unable to deal with family or co-workers. We also see people who suffer from depression and fatigue. You can help loved ones by encouraging them to get proper medical treatment.
You can also help raise awareness by getting politically active. Contact your state legislators and tell them to end insurance company abuse. Insurance companies frequently accuse people of exaggerating their symptoms and will often use independent medical examinations to dispute benefits. Many of these “independent” doctors make a career out of testifying for insurance companies.
Social media is a powerful way to show your support. Login to Facebook and click on Michigan Auto Law. They will donate $1 to the Brain Injury Association of Michigan for every “Like” they receive throughout March.
